OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees  in that employees were exposed to falls, struck-by, and/or crushing hazards by working from an extended scissor lift positioned in a moored vessel:   (a) On or about November 22, 2025,  employees performing  work on a moored vessel (Hillbilly Deluxe/Capella) were exposed to a fall and crushed-by hazards when working from a scissor lift while performing ship repair operations.

29 CFR  1915.73(c): When employees are working around open hatches not protected by coamings to a height of 24 inches or around other large openings, the edge of the opening shall be guarded in the working area to height of 36 to 42 inches.  (a)On or about November 24, 2025, and at times prior thereto, employees working aboard the Hillbilly Deluxe /Capella Vessel were  exposed to a fall of approximately 27 feet to the lower level when their employer failed to ensure that large openings and or open hatches were protected by coamings to a height of 24 inches.

29 CFR 1915.73(d): When employees were exposed to unguarded edges of decks, platforms, flats, or similar flat surfaces, more than 5 feet above a solid surface, the edges were not guarded by adequate guardrails meeting the requirements of 29 CFR 1915.71(j)(1) and (2).  (a)On or about November 24, 2025, and at times prior thereto, employees working aboard the Hillbilly Deluxe /Capella Vessel were exposed to fall hazards of approximately 15 feet when unguarded edges of decks and other elevated flat surfaces were not protected with guardrails that complied with 29 CFR 1915.71(j)(1) and (2).

29 CFR  1915.73(e):When employees were working near the unguarded edges of decks of vessels afloat, they were not protected by personal flotation devices meeting the requirements of 29 CFR 1915.158(a).  (a) On or about November 24, 2025, and at times prior thereto, employees working and transiting around the main decks of  the Hillbilly Deluxe /Capella vessel were exposed to drowning.

29 CFR  1915.74(a)(1):The employer permitted employees to board or leave a vessel by using a gangway with less than 20 inches walking surface, of adequate strength, maintained in safe repair, and safely secured.  (a) On or about November 24, 2025, and at times prior thereto, employees transiting the gangway to access the Hillbilly Deluxe /Capella Vessel were exposed to serious injuries when their employer failed to ensure that the gangway was maintained in safe repair. The metal mesh material on the surface of the gangway was not properly secured which created a slip, trip and fall hazard.

29 CFR  1915.74(a)(8):The employer permitted employees to board or leave a vessel by using a gangway where the supporting bridles were not kept clear so as to permit unobstructed passage for employees.  (a) On or about November 24, 2025, and at times prior thereto, employees were exposed to serious injuries when working and transiting aboard the Hillbilly Deluxe /Capella vessel.  The supporting bridles of the gangway created obstructed access which is likely to result in a slip, trip, or fall.
