29 CFR 5a.0001: Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by or ran over by commercial highway vehicle. a) On or about May 27, 2011, an employee was being exposed to being struck by and or ran over by a commercial highway dump truck vehicle while attempting to start and starting the vehicle from underneath the vehicle chassis without the application or availability of a parking brake. Among other methods two feasible and acceptable method to correct this hazard would be to follow; 1) the Construction Industry Manufactures Association (CIMA) Safety Manual for Operating and Maintenance Personnel, (section 12) Start Safely; and 2) Follow the National Highway Traffic Safety Administration, Department of Transportation 49 CFR 393.41 (c)(2), "The parking brake system shall at all times be capable of being applied in conformance with the requirements of paragraph (a) of this section by either the driver's muscular effort, or by spring action, or by other energy, provided, that if such other energy shall be isolated from any common source and used exclusively for the operation of the parking brake"g
