Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being struck and crushed by heavy
equipment:
a.) in that the employer did not prohibit the use of a pallet-fork
attachment on
a John Deere 544H front-end loader, as noted on 03/21/2011.  The front-end
loader was equipped with a JRB quick coupler and designed for specific
attachments which were secured by hydraulically controlled locking pins.
The
pallet-fork attachment was not designed to accept the locking pins and
merely
rested on the quick coupler secured only be its own weight.  On or about
03/18/2011, during transit to a nearby grove, the pallet-fork attachment
came
off and was run over by the front-end loader.  This action ejected the
operator
in front and to the side of the loader resulting in fatal injuries.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to ensure all attachments used on the front-end
loader
(and other equipment) are designed to be securely attached and safely
operated.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being struck and crushed by heavy
equipment after
being thrown from the equipment:
a.) for the operators of a John Deere 544H front-end loader, as noted on or
about 03/21/2011.  The seatbelt for the front-end loader had been secured
under the seat prohibiting its use by the operators.  On or about
03/18/2011,
about one-half mile east of 1762 S. Lake Reedy Blvd in Frostproof (FL), an
operator was ejected from the front-end loader after a pallet-fork
attachment
came off and was run over during its transit to a grove.  After being
ejected to
the front and side of the loader, the operator was run over and sustained
fatal
injuries.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to ensure all operators follow the manufacturer's
instructions requiring the use of the seat belt during its operation.
Additionally, an inspection checklist could be used, and enforced, to
ensure
operators verify the seatbelt's ability to be used.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being struck by fragments of
Polyvinyl Chloride
(PVC) Plastic Pipe in the event that the PVC plastic pipe ruptures:
a:) for employees using compressed air located in the mechanics' work area
at
1762 S. Lake Reedy Blvd in Frostproof (FL), as observed on or about
03/21/2011.  The facility used PVC plastic piping in exposed above ground
locations to distribute compressed air throughout the maintenance areas.
The
piping interconnected three different compressors operating at about
110psi.
The use of PVC plastic pipe in exposed above ground locations is not
recommended by the Plastic Pipe Institute, and such use is prohibited by
ANSI/ASME B31.8-1986, Gas Transmission and Distribution Piping Systems
Standard.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to replace all existing PVC pipes and fittings with
cast
iron materials, other types of metal piping, or compressed air hoses which
are
rated to transport compressed air safely in exposed above ground
locations.
