Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about 9/13/11 at the Mumford facility; employees who transfer liquified petroleum gas, operate pumps, valves and hoses containing liquified petroleum gas and are involved in draining and emptying containers of liquified petroleum gas were last trained on these activities May 13, 2008. ABATEMENT DOCUMENTATION REQUIRED Section 4.4 of the 2011 National Fire Protection Associate Code 58, Liquified Petroleum Gas states: " Persons who transfer liquid LP-Gas, who are employed to transport LP- Gas, or whose primary duties fall within the scope of this code shall be trained in the proper handling procedures. Refresher training shall be provided at least every 3 years. The training shall be documented. Suggested abatement action would be to train employees involved in the transfer and operation of equipment containing liquified petroleum on the required steps to safely perform each required task or activity at least every three years.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about 9/13/11 at the Mumford, New York facility; emergency shut off valves are inspected on a monthly basis as part of the site Monthly Inspection Checklist, but annual testing was not completed in 2010 or 2011. ABATEMENT DOCUMENTATION REQUIRED Section 6.12.9 of the NFPA Liquified Petroleum Gas Code, 2011 edition, requires emergency shut off valves required by the code shall be tested annually for the function required by 5.12.4 (2) and (3) and the results documented. Section 5.12.4 states: Emergency shut off valves shall be approved and shall incorporate all of the following means of closing: (2) Manual shutoff from a remote location (3) Manual shutoff from at the installed location. Note: Section 10.9 of the NFPA Liquified Petroleum Gas Code, 2004 edition, requires annual testing of emergency shut off valves. Feasible and acceptable means of abatement would be to conduct an annual test of the emergency shutoff valves and document the action of both the shutoff from a remote location and at the installed location.
