Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that employees were exposed to a struck-by hazard: (a)On or about 06/15/2011 - Spindle Top subdivision, Guntersville, AL, employees clearing trees were walking in close proximity to a JOHN DEERE 160C excavator, serial number FF160CXO45580, that was moving tree logs. Among other methods, one feasible and acceptable method to correct this hazard would be to ensure that a signal person is provided and in view of the working area, as stated in the Operator's Manual, "Avoid Work Site Hazards" section.
