Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that employees were exposed to struck-by and crushed-by hazards: a. On or about 06/30/11, employees operated a Hyster-50 forklift that was not equipped with a safety restraint system. Among other methods, one feasible and acceptable method to correct this hazard would be to ensure that all forklifts in use are retrofitted with a restraint device and drivers utilize restraint devices as stated in ASME B56.1-2003, "Safety Standard for Low Lift and High Lift Trucks", Section 7.41, Operator Restraint Systems.
