Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a possible entrapment of the head and torso between the forklift and the floor or other surface while operating the forklift should a tip-over of the forklift occur. One feasible and acceptable abatement method to correct this hazard is to mandate the use of operator restraint devices on the forklift (seat belts). WAREHOUSE AREA: THE TOYOTA FORKLIFT SER 12366 WAS BEING OPERATED BY AN EMPLOYEE WHO WAS NOT WEARING THE FACTORY INSTALLED SEATBELT.
