Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized
hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a possible entrapment of the head and torso between the
forklift and the floor
or other surface while operating the forklift should a tip-over of the
forklift occur.  One feasible
and acceptable abatement method to correct this hazard is to ensure the
use of the operator
protection device (seat belt) while the forklift is being operated.
SHIPPING/RECEIVING:  THE SEAT BELT FOR THE CLARK FORKLIFT WAS
ATTACHED TO ITSELF IN FRONT OF THE SEAT INDICATING THAT THE BELT IS
NOT BEING WORN WHEN THE FORKLIFT IS BEING OPERATED.
