Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a possible entrapment of the head and torso between the forklift and the floor or other surface while operating the forklift should a tip-over of the forklift occur. One feasible and acceptable abatement method to correct this hazard is to provide an operator protection (restraint) device on the forklift such as seat belts: (a) ESTABLISHMENT -- EMPLOYEE(S) WERE OPERATING A CLARK, MODEL #C500Y 55, SERIAL #Y355-360-2550, PROPANE POWERED FORKLIFT TRUCK, WITHOUT THE USE OF A RESTRAINT DEVICE, SUCH AS A SEAT BELT, EXPOSING EMPLOYEE(S) TO POTENTIAL INJURY IN THE EVENT OF A TIP-OVER OF SAID FORKLIFT TRUCK DURING OPERATION.
