Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being struck by vehicular traffic:
North Searsport Road, Frankfort - Correct temporary traffic control
procedures were not
implemented while employees were conducting line clearance operations that
closed the
northbound lane of the two lane road.

for Arboricultural Operations, Section 3.2.2: Effective means for
controlling pedestrian and
vehicular traffic shall be instituted on every jobsite where necessary, in
accordance with the
U.S. Department of Transportation (DOT) Manual on UniformTraffic Control
Devices
(millennium edition) June 14, 2001 Section 6C.10. When traffic in both
directions must use
a single lane for a limited distance, movements from each end shall be
coordinated.
