Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees while performing aerial lift truck operations. (a) An employee was exposed to falling and being crushed, and/or striking objects, in the event he was thrown from the aerial lift bucket. An employee was observed, on April 07, 2011, riding in the basket of a truck mounted aerial lift as the truck was driving at a speed in pace with adjacent traffic, on a posted 45 mph public highway. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS: Ensure compliance with the applicable equipment operator's manual, i.e., Posi-Plus Technologies, Cable Placer 800 Series Operators Manuel, which mandates that vehicle speeds will not exceed 2 miles per hour when workers are positioned inside aerial lift baskets. Abatement Note: Abatement certification is not required for this item.
