Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while climbing on the guardrails of a/an scissor lift(s): a) On January 31, 2012 at the job site located at #4 Business Loop 70E in Columbia, MO, employees were exposed to fall from height hazards in that they were climbing onto the guardrails of elevated scissor lifts to gain access to and from the roof of the gas station canopy. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS: Comply with ANSI/SIA A92.6-1999, Self-Propelled Elevating Work Platforms which states in Chapter 7.10(9) that "personnel shall maintain a firm footing on the platform floor while working thereon. Climbing by occupants on the midrail or toprail of the aerial platform is prohibited." Abatement certification is not required for this violation.ion
