employees.  In applying
this paragraph, fundamental distinctions between private and public
employment have been
recognized:
a) Palatine Tn Hwy Dept - The employer did not furnish employment and a
place of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees.  On December 13, 2011, an employee working on
Oswegatchie
Road was cutting tree limbs from the bucket of a John Deere 544 G Loader
that was
approximately 20 feet above the ground.
Note: A reasonable and adequate method to correct the hazard includes, but
is
not limited to,
following the manufacturer's instructions on proper usage of the John
Deere 544 G Loader or
using aerial lift equipment that is designed for lifting personnel. Also,
following the
recommendation made by the National Institute of Safety and Health
Fatality Assessment and
Control Evaluation (NIOSH FACE) Program as a result of fatality
investigation # 96-MA-016-01
for employers to instruct their employees never to ride in the bucket of a
front end loader.

be exposed to
vehicular traffic or moving equipment wear high visibility garments that
meet ANSI
requirements.
