General-duty citation text
NYSLL Article 2, Section 27-a.3.a(1): The employer did not furnish to each of its employees, employment and a place of employment which was free from recognized hazards that are causing or were likely to cause death or serious physical harm to its employees and which will provide reasonable and adequate protection to the lives, safety or health of its employees. In applying this paragraph, fundamental distinctions between private and public employment have been recognized: a) Copenhagen Vill DPW - The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. Employees were elevated in the bucket of a New Holland TN55D Farm Tractor to hang Christmas decorations, hang flags and change light bulbs in the Village of Copenhagen. Note: A reasonable and adequate method to correct the hazard includes, but is not limited to, following the manufacturer's instructions on proper usage of the New Holland TN55D Farm Tractor with bucket or using aerial lift equipment that is designed for lifting personnel. Also, following the recommendation made by the National Institute of Safety and Health Fatality Assessment and Control Evaluation (NIOSH FACE) Program as a result of fatality investigation # 96-MA-016-01 for employers to instruct their employees never to ride in the bucket of a front end loader.
