North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from elevation: a)warehouse - where employees were periodically elevated by a powered industrial truck, standing either on the forks or an empty pallet, to retrieve products or access the racking system. Among other methods, one feasible method to correct this hazard is to follow the forklift manufacturer's recommendations prohibiting lifting anyone with the truck unless they are using an approved platform.ng
