North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by injuries. a)assembly area, the in-house fabricated bracket (below- the-hook lifting device) used by employees to lift and palletize sewing system units was not tested and load rated prior to use. b)assembly area, for the sewing system unit palletizing process, where employees placed their hands/fingers under 400-760 pound loads, to remove frame casters when the loads were suspended. Feasible methods of abatement include ensuring all below-the-hook lifting devices are designed, manufactured, and maintained in accordance with American National Standards Institute (ANSI) B30.20 - 2006 and employees follow the Coffing Hoist Manual that states, "all persons stay clear of the suspended load".
