Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being crushed: a) Corner of Pomeroy & Sheridan RD, SE - On
or about May
3, 2011, workers operated a BOMAG BW177 D-3 vibration roller compactor and
a Mustang
MTL25 compact track loader within 3 feet of a 8' to 13' retainer wall that
was under
construction. Among other methods, one feasible and acceptable abatement
methods to correct
this hazard is to follow the National Concrete Masonry Association's
retaining wall procedures
which states "As with any structure used to retain soil, careful attention
should be paid to the
compaction equipment and procedures used during construction. When
compacting soil within
3 ft (0.9 m) of the front face of a wall, compaction tools should be
limited to hand operated
equipment, preferably a vibrating plate compactor. Reinforced soil can be
compacted
with walk-
behind or self-propelled riding compaction equipment. to ensure that the
equipment is operated
at least 3 feet from the retaining wall during construction".
