Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm:
a) Jobsite, 100 32nd Avenue, Pittsburgh, PA: On or about October 1, 2011,
the employer did
not ensure workers were protected from hazards such as falls or being
caught in forklift moving
parts in that employees were being raised up on the forks of a Hi-Lo
forklift and/or a pallet on
the forks of a Crown Hi-Lo forklift to heights of approximately 13 feet.
No fall protection was
provided and no machine guarding was provided to prevent contact with
moving parts such as
the lift drive chain and sprocket. Among other methods, one feasible and
acceptable abatement
method would be to comply with the precepts of the section 4.17 of the
American National
Standards Institute, B56.1, 2009 edition, Safety Standard for Low Lift and
High Lift Trucks,
which requires fall protection and machine guarding to be used when
elevating persons.
