Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to dust explosion, deflagration, and fire hazards:
(a)In the facility, on or about February 22, 2012 - Woodworking equipment
such as
a belt sander generates sparks.  Wood debris from this equipment enters
metal
duct work.  This duct work is not equipped with a listed spark detection
system.
(b)In the facility, on or about February 22, 2012 - The hopper used to
collect the
wood dust was constructed entirely of wood.
(c)In the facility, on or about February 22, 2012 - The employer did not
retain the
records relating to its dust collection system.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD TO CORRECT THESE HAZARDS IS TO COMPLY WITH NATIONAL
FIRE AND PROTECTION AGENCY (NFPA) 664, STANDARDS FOR THE
PREVENTION OF FIRES AND EXPLOSIONS IN WOOD PROCESSING AND
WOODWORKING FACILITIES (2007) INCLUDING, BUT NOT LIMITED TO:
* INSTALL DUCTS WITH A FIRE HAZARD CAPABLE OF CONVEYING
DRY MATERIAL RELEASED BY EQUIPMENT, SUCH AS A BELT
SANDER, WHICH HAVE THE HIGH FREQUENCY OF GENERATED
SPARKS WERE NOT DESIGNED AND CONSTRUCTED TO BE EQUIPPED
WITH A LISTED SPARK DETECTION SYSTEM ACTUATING A HIGH
SPEED ABORT GATE, PROVIDED THE ABORT GATE CAN OPERATE
FAST ENOUGH TO INTERCEPT AND DIVERT BURNING EMBERS TO
ATMOSPHERE BEFORE THEY CAN ENTER ANY COLLECTION OR
STORAGE EQUIPMENT AS LISTED IN CHAPTER 8, PARAGRAPH
8.2.2.2.2 OF NFPA 664.
*DESIGN AND CONSTRUCT THE COLLECTION EQUIPMENT ENTIRELY
OF NONCOMBUSTIBLE MATERIAL SUITABLE FOR THE USE INTENDED
AS LISTED IN CHAPTER 8, PARAGRAPH 8.2.2.5.1.2 OF NFPA 664.
*REQUIRE AND RETAIN THE RECORDS TO INCLUDE, BUT NOT
LIMITED TO, DRAWINGS AND SUPPORTING DOCUMENTS RELATING
TO INITIAL INSTALLATION/PURCHASE OF EQUIPMENT, ROUTINE
EQUIPMENT INSPECTIONS, TESTING AND REPAIR, HISTORY, FIRE
AND SAFETY INSPECTION OR AUDIT REPORTS, SERVICE RECORDS,
AND MANUFACTURER'S DATA SHEETS AS LISTED IN CHAPTER 10,
PARAGRAPH 10.3.1 OF NFPA 664.
