Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: (a) Jobsite: 213 Indian Meadows Drive, Mars, Pa 16046; On or before February 23, 2012, an employee was working unprotected and exposed to falling approximately 11 feet 4 inches while removing brick from an elevated unguarded wooden pallet which was raised up to the scaffold platform level by a Gehl 553 DynaLift- All-Terrain Forklift. Among others, one feasible and acceptable method to abate this hazard is to use a platform meeting the design and use criteria set fourth in the Industrial Truck Development Foundation (ITSDF) B56.1-2005 standard.
