Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to fall hazards while working
from a wooden pallet elevated in the air attached to a forklift:
(a)Facility, Blending Department, 3539 Oneida Valley Road, Emlenton, PA:
On or about 02/29/12, an
employee was working from an unguarded wooden pallet that was attached to
a Clark forklift at an elevated
height of approximately 10 feet above the floor.  The employee is lifted
on the pallet with a drum of materials
up to the opening on the mixer and dumps the materials from the drum into
the mixer exposing the employee
to a fall hazard of approximately 10 feet.
(b)Facility, Grinding Department, 3539 Oneida Valley Road, Emlenton, PA:
On or about 03/05/12, an
employee was working from an unguarded wooden pallet that was attached to
the
Komatsu forklift at elevated
heights of approximately 7-10 feet above the floor.  The employee steps
onto the pallet at approximately 10
feet from the platform after positioning the super sack and then is
lowered to approximately 7 feet to untie the
closure on the sack to release the material.  The employee continues to
ride the pallet as it is lowered to the
floor.  The employee is exposed to fall hazards of approximately 7-10 feet.
Among other methods, one feasible and acceptable abatement method to
correct these hazards is to comply
with ANSI/ITSDF B56.1-2009 Safety Standards for Low Lift and High Lift
Trucks, Sections 4.17.1, 4.17. 2
and 4.17.3.

employees in that employees
were exposed to falling from defective ladder:
(a)Blending Department, 3539 Oneida Valley Road, Emlenton, PA:  On or
about 02/29/12,
the employees were using a 10 ft. Werner non-conductive fiberglass step
ladder that was
damaged in that the rear side rail was broken and had been repaired by
duct taping a piece of
wood between the cracked rail for support.  In addition, the ladder legs
did not sit firmly on the
ground and employees used pieces of wood or metal to shim the ladder to
level it.  The
employees use the ladder daily to access the hatch on the blender.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to provide ladders that meet the requirements of ANSI A14.5, Ladders -
Portable Reinforced
Plastic - Safety Requirements and to perform inspections and maintenance
of ladders and remove
ladders from service when damaged as described in ANSI A14.5, section 9.
