North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a) on the construction site, metal silt fence poles were directly adjacent to the scaffold and exposed employees working on the scaffold to impalement hazards. Among other methods, one feasible and acceptable method to abate this hazard is to remove or relocate the metal silt fence poles from the scaffold work area.
