Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a crush hazard when working underneath automobiles being
raised by car lifts
that are not inspected on a regular basis:
a)At the time of the inspection, the employer could not produce records
proving that the
nineteen (19) car lifts located in the service department are inspected
and serviced on a
consistent basis. On Friday April 22, 2011 an employee could have been
killed when the
lift collapsed while working on a customer's automobile.
Among other feasible and acceptable methods to correct this hazard would
be to establish
a planned service procedure. 1) The car dealership shall establish a
periodic planned
service procedure with a reputable car lift inspection and service
company.
A periodic
planned service procedure should be established in accordance with the
recommendations
of the lift manufacturer in order to ensure reliability and allow the
continued safe
operation of the lifts. 2) Planned service shall follow the
recommendations of the lift
manufacturer as to frequency whether it be daily, weekly, monthly,
semi-annually,
annually or on some other basis. 3) The employer should keep a thorough
record of each
time the service company comes into your facility to inspect and service
your lifts.

a) The employer is not limited to the abatement method(s) suggested by
OSHA.
B) The employer is responsible for selecting and implementing an effective
abatement
method.
Abatement certification and abatement documentation is required for this
violation.
The
documentation should include written verification of abatement, applicable
measurements
or monitoring results, and photographs or videos which you believe will be
helpful.  The
abatement certification sheet is enclosed with the citation(s).
