North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by / crushed by falling vehicles while operating the vehicle lift or working beneath vehicles on the lift that had not been inspected as required by the manufacturer. a)facility - employees used a Rotary vehicle lift, Model SPOA9N400, Serial Number AR202F0605, 9000 pound capacity, to inspect and repair vehicles without performing the daily and periodic (including annual operational / lift capacity) inspections as required by the manufacturer's instructions and / or ANSI/ALI-2000, Standard for Automotive Lifts - Safety Requirements for Operation, Inspection and Maintenance, referenced in the manufacturer's Operation & Maintenance Manual. Employees were exposed to being struck by / crushed by a falling vehicle. ABATEMENT NOTE: Among other methods, one feasible method / means of abatement would be to conduct daily and periodic inspections as required by the manufacturer's instructions and / or ANSI/ALI-2000, Standard for Automotive Lifts - Safety Requirements for Operation, Inspection and Maintenance, referenced in the manufacturer's Operation & Maintenance Manual. In addition to inspections, the employer is required to maintain complete manufacturer's operating manuals and conduct operator training as referenced in the following documents, a)Rotary lift - Operations & Maintenance Manual for Model SPOA9, June 2005, p. 3 - "The Owner/Employer shall ensure that lift operators are qualified and that they are trained in the safe use and operationof the lift using, 1) manufacturer's operating instructions; 2) ALI/SMO1-1, ALI Lifting it Right safety manual; ALI/ST-90 ALI Safety Tips card; ANSI/ALI ALOIM-2000, American National Standard for Automotive Lifts-Safety Requirements for Operation, Inspection and Maintenance; 3) ALI/WL Series, ALI Uniform Warning Label Decals/Placards; and in the case of frame engaging lifts, 4) ALI/LP-Guide, Vehicle Lifting Points/Quick Refernece Guide for Frame Engaging Lifts."
