Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards: a)In the warehouse: On or about July 18, 2011 and at times prior to, the employer failed to provide a seat belt for the blue & grey powered industrial truck exposing employees to crushing hazards. One feasible and acceptable method to correct this hazard would be to install a seat belt on the older model forklifts or purchase newer model powered industrial trucks equipped with seat belts and require operators to use the restraint system in accordance with ASME B.56.1-2000 "Safety Standard For Low Lift and High Lift Trucks", Section 7.41 Operator Restraint Systems.
