Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a)In the raw material storage area: On July 22, 2011 and at times prior to, the employer failed to properly maintain racks in that the racks were damaged at the base exposing warehouse employees to struck-by hazards from falling product and rack sections while they work in the warehouse. Feasible and acceptable methods of abatement to correct this hazard include, but are not limited to the following: 1)Conform to procedures prescribed by the manufacturer in that all damaged components should be replaced with new. 2)Have the capacity of repaired storage racks certified by a competent person. 3)Conform to the American National Standard, MH 16.1: 2008, paragraph 1.4.1(2), that requires damaged racks to be replaced/repaired.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a)In the raw material storage area: On July 22, 2011 and at times prior to, the employer failed to adequately enforce the use of forklift operator seat belts exposing warehouse employees to struck-by hazards from falling out of the forklift. Feasible and acceptable methods of abatement to correct this hazard include, but are not limited to the following: 1)Conform to procedures prescribed by the manufacturer that requires all operators to use the restraint devices when operating the forklift. 2)Conform to the American National Standard, ASME B 56.1-2000, that requires the operators to wear seat belts.
