Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of eye injuries due to exposure to corrosive chemicals: a) On or about 07/13/11, and at times prior there to, employees were working in the battery changing area. This area contains corrosive battery acid. The employees service these batteries by adding water to the cells. There is an eyewash station in the area, however, according to the inspection tag, it had not be inspected since 01/12/09. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition may include: Ensure that eyewash units are activated at least weekly to ensure proper operation and to flush out sediments that may accumulate in the plumbed lines as stipulated in ANSI standard Z358.1-1998.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of fall, struck-by and crushed-by: a) On or about 07/13/11, and at times prior there to, an employee was observed operating a Nissan, Model MCU1F2A251V, forklift without wearing the required seatbelt. The employee was moving product around the refrigerated warehouse. The employer does not ensure that employees operating powered industrial trucks use seatbelts, exposing employees to the hazard of falling out of and being struck by the powered industrial truck. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow ITSDF/ANSI B56.1-2005, Section 5.1.4 which requires that all operators read and follow the manufacturer's operator manual and abide by the safety rules and practices.er's
