Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Employee(s) who operate the Milwaukee Dymodrill did not use anchor bolts on porous asphalt surface causing the base to come loose and a struck-by hazard. AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE ABATEMENT METHODS TO CORRECT THIS HAZARD ARE TO: PROVIDE AND ENSURE EMPLOYEES ARE USING ANCHORS WHEN SETING UP AND USING THE CORE DRILL ON POROUS SURFACES. IN ACCORDANCE WITH MILWAUKEE OPERATORS MANUAL FOR THE MILWAUKEE DYMODRILL, UNDER SPECIFIC SAFETY RULES ON PAGE 3, NUMBER 7, IT STATES: "ALWAYS USE ANCHORS BOLTS TO SECURE THE BASE ON CRACKED, UNEVEN, POROUS OR VERTICAL SURFACES."
