Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to the hazards of being caught by and falls from the elevation: (a) On or about 10/28/11 and at times prior thereto, employee(s) were riding within the excavator bucket to gain access inside an excavation to seal lifting eye pockets on the trench box to prevent rain and mud from accumulating into the excavation, exposing employee(s) to the hazard of falling approximately 21 feet, being struck by the bucket, and caught-in-between hazards associated with the boom and bucket of the John Deere model 800C serial number FF800CX971093 excavator. Among other methods, one feasible and acceptable abatement is to follow the owner's manual for the John Deere excavator 800C which reads: "Only allow operators on machine. Riders are subject to injury. They may fall from machine, be caught between machine parts, or be struck by foreign objects.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to crushed by hazards: (a)On or about 10/28/11 and at times prior thereto, the employer did not ensure employee(s) slide the safety pin all the way right before the swing latch is lowered over rear attachment pin and ensure the safety latch pin was available and used. This condition exposed employee(s) to the hazard of being struck by the bucket and/or crushed by the bucket. Among other methods, one feasible and acceptable abatement is to follow Central fabricators owners manual, which reads: "Slide safety pin all the way right BEFORE swing latch is lowered over rear attachment pin. Latch lock arm MUST BE ABOVE safety pin to properly couple with attachment. UNCURL ATTACHMENT AND CHECK INDICATOR PLATE FOR LATCH ENGAGEMENT. ENGAGE SAFETY LATCH PIN. At the rear of the Quick Latch (away from the operator's seat), remove the lynch pin from the safety latch pin. Slide the safety latch pin from the rest position to the left - to the latched position. Install the lynch pin in the opposite end of the safety latch pin."
