Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of being struck by  motor vehicle(s).
On or about 15 December 2011, and at times prior thereto, an employee
traversing a public
parking lot on foot at a CEFCO truck stop in Cameron TX was exposed to
high traffic hazards
from the movement of semi-tractor trailer rigs while performing truck
driving duties without the
use of a reflective vest. Employees who operate company vehicles are
subject to vehicular traffic
when making stops in the course of their deliveries and pick-upss, while
taking required breaks
at truck stops or other public businesses, or in the event of a roadside
incident such as a
mechanical breakdown.
Feasible means of abatement for this hazard, among others, includes the
following measures:
1. Provide high-visibility reflective vests or clothing to employees for
their use during periods
when they are on foot subject to vehicular traffic and/or poor visibility
due to weather
conditions.
2. Train employees to recognize and be more alert to hazards within
parking lots or along side
roadways while they are on foot.
3. Establish and maintain a safety and health program for the employee(s)
to follow emphasizing
the use of high-visibility clothing or vests while outside of the cab and
on foot.
Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date
of this citation, the
employer must submit documentation showing that it is in compliance with
the obligation,
including describing the steps that it is taking to ensure that employees
are
not protected from
the hazards of moving vehicles while on foot.
