Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about July 27, 2011, at the establishment located at 1016 South 28th Street, Suite A, in Van Burn, Arkansas, employee operating the Yale forklift in the shop area did not wear a seat belt. This condition exposed employee to the hazard of being thrown, ejected and crushed in the event of a tip-over. One feasible and acceptable method for abatement would be to ensure the usage of seat belts, communicate the usage to employees and establish a disciplinary policy for violators.ry
