North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from a traveling flatbed truck: a)on Rozzelles Ferry Road, Charlotte, North Carolina, employee was riding atop a load of construction materials which were on the back of a flatbed truck. Among other methods, one feasible and acceptable abatement method would be to ensure the occupant follows the manufacturer's driver's manual and make sure all occupants are wearing seat belts.g
