Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees in that employees were exposed to a caught-in and/or struck-by hazards: On or about August 11, 2011, and other times prior thereto, at this establishment, employees were exposed to pinch points, caught-in or between, and struck-by hazards of the industrial tilters. The industrial tilters were not equipped with toe guards and enclosures on the unprotected sides. Among other methods, one feasible and acceptable means of abatement would be to comply with the recommended methods of the manufacturer of the ZTU and ZTU Pan E-Z Reach Container Tilters Southworth Products Corporation and to comply with American National Safety Institute (ANSI) MH29.2-2000, Safety requirements for industrial tilters.
