Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The

were causing, or likely to cause, death or serious physical harm to

were exposed to fall hazards from inadequately maintained equipment:
On or about August 11, 2011, and at other times prior thereto, at customer
work
sites, employees were performing tree trimming work from a Hi-Ranger 5FA-
48PBI up to 50 feet above ground.  The equipment was inadequately
maintained
due to the absence of a preventative maintenance program requiring annual
and
frequent inspections to be performed which could detect any cracks,
hydraulic
leaks, or other defect in the equipment.
Among others, one feasible and acceptable abatement method to correct the
hazard is:
a.Establish a preventative maintenance program in accordance with the

on all aerial lift platforms according to ANSI/SIA A92.2 - "Vehicle-
Mounted Elevating and Rotating Aerial Devices" (2009) and the ANSI
Z133.1 - "American National Standard for Arborcultural Operations -
Safety Requirements" (2006), Section 5.
c.Keeping written records of these inspections according to ANSI/SIA
A92.2 (2009) and associated repairs.
