Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnished employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: ergonomic risk factors such as: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: a)Employees were exposed to ergonomic hazards such as: awkward and or sustained body posture frequently adopted and maintained during long periods of time, and repetitive body movements, lifting incorrectly weight during their working hours. Cumulative exposue to these risk factors and particulary their combination, cause or contribute to increse risk of musculoskeletal disorders. At Wear Tech, Inc., employees were engaged in repetitive motion such as rotating the torso to bend to lift packages of military pants, weighing between 50 to 65 pounds. This task was performed continuously, without rest periods, on a workstation not designed for lifting. Employees has not been properly trained in how to lift heavy materials, lift posture and how to avoid injury. On the OSHA 300, 2008, 2009, 2010, 2011 and 2012, have reported cases with days lost due to ergonomics problems. Among other methods, some feasible methods to correct these risks are: 1.Consider adjusting the workstation according to parameters recommended by relevant standards of ergonomics. 2.Use high tables and / or leveling spring. 3.Used cars (tables), adjustable in height, to avoid having to bend excessively. 4.Train employees about proper posture and how to raise weight. a)Empleados fueron expuestos a factores de riesgos ergonomicos tales como: postura del cuerpo sostenidas y /o extremas frecuentemente adoptadas y mantenidas durante largos periodos de trabajo, movimientos de cuerpo repetitivos, levantamiento de peso incorrectamente durante su jornada de trabajo. Exposicion acumulativa de estos factores de riesgos y particularmente su combinacion, causa o contribuye a aumentar el riesgo de desordenes musculo esqueletales. En Wear Tech, Inc., Empleados realizaban trabajos de movimiento repetitivos donde se giraba el torso al doblarse para levantar paquetes de pantalones militares con un peso de entre 50 a 65 libras. Dicha tarea se realiza de forma continua, sin periodo de descanso, en una estacion de trabajo no disenada para el levatamiento de peso. Empleados no han sido adiestrados en como levantar correctamente material pesados y postura correcta para evitar lesiones. En la OSHA 300 del 2008, 2009, 2010, 2011 y 2012, tienen casos registrados con dias perdidos por problemas de ergonomia. Entre otros metodos, algunos metodos factibles para corregir estos riesgos son: 1.Considerar ajustar la estacion de trabajo de acuerdo a parametros recomendados por estandares relevantes de ergonomia. 2.Utilizar mesas elevadas y/o niveladores de resorte. 3.Utilizar carros (mesas) ajustables en altura, para evitar el tener que doblarse excesivamente. 4.Adiestrar a los empleados sobre la postura y forma correcta para levantamiento de peso.tamiento

Hazard: Domestic violence in the workplace. Method to abate the hazard: The employer shall provide training to all establishments employees related to a written protocol to handle domestic violence situations in the workplace. a)El patrono Wear Tech, Inc., - no proveyo adiestramiento a sus empleados, relacionado al establecimiento de un protocolo escrito para manejar situaciones de violencia domestica en el lugar de trabajo, como lo requiere la Ley para la Implementacion del Protocolo para Manejar Situaciones de Violencia Domestica en el Sitio de Trabajo, Ley Num. 217 del 2006. Riesgo: Violencia domestica en el lugar de trabajo. Metodo para corregir este riesgo: El patrono tiene que proveer adiestramiento a todos los empleados del establecimiento relacionado con un protocolo escrito para el manejo de situaciones de violencia domestica en el sitio de trabajo.a
