Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about August 23, 2011 at the jobsite located at 1601 West Third, North Little Rock, AR, an employee was operating a rough terrain powered industrial truck with a bucket attachment without using the seatbelt. This condition exposed the employee to the hazard of being ejected from the powered industrial truck in the event of a tip over and stuck by the falling object protective structure (FOPS) and/or other parts of the powered industrial truck. Feasible abatement methods include establishing a policy that requires the use of seat belts, requires communication of it to employees, and enforces the use of the seat belts.es
