Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to "caught by" and crushing hazards when the employer failed to
guard a hydraulic
stage lift.
Show Vault, Viejas Outlets - On June 11, 2011, an employee of Viejas
Entertainment &
Productions was caught and seriously injured while entering an active
performer's
hydraulic stage lift. The employer failed to provide a maglock safety
device having a
"senstat" sensor that ensures the hydraulic stage lift door is closed
prior to any activation
or movement. In addition, the hydraulic stage lift was not maintained and
operational as
intended by the stage lift design, and that a previously designed paver
enable switch was
not in place.
AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE METHODS TO CORRECT
THIS HAZARD ARE:
Replace or repair all missing, broken or disabled safety devices and
operate the lift according
to the stage lift design and manufacturer's recommendations.
The employer must ensure that its employees are provided adequate training
guidelines and safe
operational procedures as established by the manufacturer and other
qualified persons
The employer must ensure that a safety inspection program be developed and
implemented by
a qualified person with accordance to manufacturer's recommendations.
