Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being struck by oncoming vehicular traffic.
(a) Location - Bruce Street, Methuen, MA:
On or about 07/12/2011, employees were not readily and highly visible to
oncoming
vehicular traffic.
Among other methods, one feasible and acceptable means to correct the
hazard is to
develop a clear, concise work rule pertaining to all safety aspects of
working with and
around the McNeius rear loader refuse truck. Manual on Uniform Traffic
Control
Devices Section 6E.02 MUTCD For daytime and nighttime activity, flaggers
shall wear
safety apparel meeting the requirements of ISEA "American National
Standard for High-
Visibility Apparel" High-Visibility Safety Apparel Standard: All workers,
including
emergency responders, within the right-of-way who are exposed either to
traffic (vehicles
using the highway for purposes of travel) or to work vehicles and
construction equipment
within the TTC "temporary traffic control" zone shall wear high-visibility
safety apparel
that meets the Performance Class 2 or 3 Section 6E.01 Qualifications for
Flaggers
Because flaggers are responsible for public safety and make the greatest
number of
contacts with the public of all highway workers, they should be trained in
safe traffic
control practices and public contact techniquesand or American National
Standards
Institute (ANSI) for Mobile Wastes and Recycles Materials Collection,
Transportation,
and Compaction Equipment Safety Requirements (ANSI) Z245.1-2008 including
but not
limited to following Paragraphs of the standard: 6.1.7.8 Requiring high
visibility apparelity

employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to injury from a moving trash truck, including falling from
the vehicle while
standing on an area which is not designed for the purpose of standing and
riding and being
crushed against a stationary object while travelling on the truck in
reverse:
(a) Location - Bruce Street, Methuen, MA:
On or about 07/12/2011, an employee was exposed to the hazard of falling
from a trash
truck to the ground below, while riding on the rear hopper sill of the
truck.
(b) Location - Bruce Street, Methuen, MA:
On or about 07/12/2011, an employee was exposed to being crushed against a
stationary
object while riding on the exterior of the trash truck operating in
reverse.
Among other methods, feasible abatement methods include: enforce
compliance with the
American National Standards Institute (ANSI) for Mobile Wastes and
Recycles Materials
Collection, Transportation, and Compaction Equipment Safety Requirements
(ANSI)
Z245.1-2008 including but not limited to following pargraphs of the
standard: 6.2.3.2
h) Making sure the locations of all co-workers are known before operating
the vehicle
in reverse Also NSWMA/WASTEC Manual of Recommended Safety Practices  1.
Develop and implement a company policy prohibiting employees from riding
on the truck
when the vehicle is backing up, when the vehicle is exceeding 10 mph or
operating in
reverse, or when the distance travelled exceeds 2/10 mile. 2. Train
employees in the
company's policies on riding in the rear of trash trucks. 3. Implement a
program for
monitoring employee's operation of equipment and adherence to safe
practices. Note: in
addition to abatement certification, the employer is required to submit
abatement
documentation for this item in accordance with 29 CFR 1903.19cee
