Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to severe physical bodily injuries and/or death from an aerial lift being tipped over: Worksite: The employer did not ensure through providing specific training, observation and evaluation of the ground conditions that the self-propelled articulating boom aerial lift, was safely and appropriately stabilized before allowing employees to commence the task of installing sheeting on the exterior wall at a height of approximately 15 feet above the ground. Small and loosed pieces of wooden blocks were placed underneath two (2) rubber tired wheels, which was located on a side slope, to level the lift while two (2) employees were in the basket of the lift performing the above task. Among other methods, one feasible and acceptable means to correct the hazard is to: 1. Follow the JLG's operator's manual safety rules;"Do not raise the platform or drive from an elevated position unless the machine is on firm, level and smooth surfaces." 2 Evaluate the conditions of the ground to ensure that lift was properly, safely and appropriate stabilized. 3. Train employees accordingly. 4. Utilize other safe and effective engineering means.
