Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of struck by at: 14900 Jacinto Port Blvd., Houston, TX 77015, when on December 13, 2011, an unsecured bundle of pipe shifted, becoming unstable and falling from the powered industrial truck's tines onto the truck driver who was standing next to the tractor trailer, when a bundle of pipe weighing approximately 5,974 pounds struck him. A feasible abatement method, among others would be: require employees to vacate the trucks cab and the loading/unloading area until all items have been loaded/unloaded onto/from the transport truck.
