North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees conditions of employment
and a place of employment free
from recognized hazards that were causing or likely to cause death or
physical harm to employees in that
employees were exposed to being struck by falling loads:
a)Metal Shop -  there were two jib cranes (1 ton capacity and 1/2 ton
capacity) on the one
building structural support.  The two jib cranes had not been load tested
to ensure that
the building structural support could bear the load applied by both jib
cranes, and to
ensure that the jib cranes could bear the load that they were rated to
hold.  The cranes
were used to lift and support bronze sculptures as finishing activities,
such as grinding
and sanding, were completed on them.
b)Foundry - The crane that was used to lift and move the crucible
containing molten
bronze had not been load tested.

(a)Prior to initial use, all new, extensively repaired, and altered
equipment should
be tested and inspected by, or under the direction of, an appointed or
authorized
person, and a written report should be furnished by such person,
confirming the
load rating of the system.  The load rating should not be more than 80
percent
of the maximum load sustained during the test.  Test loads shall not be
more
than 125 percent of the rated load unless otherwise recommended by the
manufacturer.  The test reports shall be placed on file.
NOTE:  Among other means of abatement, one feasible and acceptable method
to correct this
hazard is to load test the crane system, which includes all parts of the
lifting
components.
c)Metal Shop - there were two jib cranes installed on one building
structural support.
Both jib cranes were equipped with hoists.  The lifting systems were used
to lift and
support bronze sculptures as finishing activities, such as grinding and
sanding, were
completed on the sculptures.  The upper limit switches on the two hoists
were not tested
without a load at the beginning of each work shift.
d)Foundry - the bridge crane installed in the area was equipped with a
hoist. The lifting
system was used to lift the crucible containing molten bronze.  The upper
limit switch
of the hoist was not tested without a load at the beginning of each work
shift.

(b)Items such as the following shall be inspected at intervals as defined
in
11-2.1.1(b)(1).  Observation should be made during operation for any
defects or
damage which might appear between inspections.  Any deficiencies, such as
listed, shall be carefully examined, and a determination made as to
whether they
constitute a hazard:
(1)All functional operating mechanisms for misadjustment
interfering with proper operation.
(2)All limit switches should be checked, without a load, on the
hook, at the beginning of each work shift.  Care shall beexercised.  Each
motion shall be inched to its limit switch or run
in slow speeds.
(3)Leakage in lines, tanks, valves, pumps, and other parts of
pneumatic or hydraulic lines.
NOTE:  Among other means of abatement, one feasible and acceptable method
to correct this
hazard is to test the upper limit switches of all hoists at the beginning
of each work shift.ing
