Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to struck-by hazards:
On or about 11/09/11, at 2535 Ivy Street E, Cumming, Ga; an employee was
observed operating
a powered industrial truck without wearing a seat belt. The employee was
observed leaving the
sorting building in transition to the storage/loading dock building to
load
baled materials into
trailers.
One means of abatement would be to provide training to employees that they
are required
to wear their seatbelts at all time while operating powered industrial
trucks.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in
addition, documentation demonstrating that abatement is complete must be
included with
your certification.  This documentation may include, but is not limited
to, evidence of the
purchase or repair of the equipment, photographic or video evidence of
abatement, or other
written records.

On or about 11/09/11, at 2535 Ivy Street E, Cumming, Ga; employees were
exposed to struck-
by hazards where the compressed air used for pneumatic tools was being
transported at 100
p.s.i. through PVC pipes. The condition has existed for the past ten years
and the employer
indicated that the pipe had been installed by a professional company that
recommended the
materials.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to: Only use material with shatter resistance properties. (Reference
