Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fall hazards while riding in the cargo area of a pickup
truck.
On or about November 9, 2011, employees were exposed to struck-by hazards
when employees
were permitted to ride in the cargo area of a pickup truck when traveling
to/from the office and
rail car areas.
The S10 pickup truck owner's manual states the following on page 1-7:  It
is extremely
dangerous to ride in a cargo area, inside or outside of a vehicle. . . Do
not allow people to ride
in any area of your vehicle that is not equipped with seats and safety
belts.
Among other methods, one feasible and acceptable abatement method to this
hazard
is to prohibit
employees from riding in any area of the truck that is not equipped with
seats and seatbelts.
In accordance with 29 CFR 1903.19(c), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
