employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to struck by hazards:
On or about January 23, 2012, in the warehouse:
Employees were exposed to struck-by hazards while working in aisles from
falling
materials stored on a metal storage rack that had damaged legs from being
struck by
powered industrial trucks.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE MEANS OF
ABATEMENT TO CORRECT THESE HAZARDS IS:
Repair and/or replace damaged racks in accordance with, MH 16.1:2008,
Section 1.4.9. In
addition, the pertinent portions of the racks shall be taken out of
service immediately until
repairs are made.

were not utilizing the forklift operator restraint system (seat belts),
exposing employees to
crushing injuries in the event that the forklift tipped over:
On or about January 23, 2012, in the Belnick Inc. warehouse:
An employee was exposed to caught-between and rollover hazards while
operating a
Toyota Model 7FBEU20 Electric Forklift without using seat belts.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE MEANS OF
ABATEMENT TO CORRECT THESE HAZARDS IS:
The employer enforces the use seat belts while operating powered
industrial trucks in accordance
with, ANSI/ITSDF B56.1-2009, Section 5.3.19, an active operator protective
device
or system
shall be used.
