Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to: a struck-by hazard and an impalement hazard from the
unprotected open cab.
On or about Wednesday March 21, 2012 on site at 2156 Athens Highway
Gainesville, GA
30507;
a). The employees operating the Bobcat S220 Skid Steer Loader while
grabbing,
transporting and dumping large amounts of metal material and placing it
into an into pile
was not provided protection from material entering the front of the cab
opening.
Among other methods, one feasible and acceptable means of abatement
include, but not limited,
to: The employer shall ensure the special application kit is installed on
the equipment when
working in areas that may cause flying debris or objects to enter the
front of the cab.
No abatement certification or documentation is required for this item.

On or about Wednesday March 21, 2012 on site at 2156 Athens Highway
Gainesville, GA
30507;
a). The employees working on the upper and lower floor levels in the
facilities
production and storage areas are exposed to collapse and crushing hazards
from the
damaged and improperly secured columns and supports structures. Large
metal and wood
material are stored on the upper level of the facility.
Among other methods, one feasible and acceptable means of abatement
include, but not limited,
to: The employer shall ensure they follow the requirements in the 2009
International Building
Code page 305 and sections 1604.1 and 1604.2 of the General Design
Requirements.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in
addition, documentation demonstrating that abatement is complete must be
included with
your certification.  This documentation may include, but is not limited
to, evidence of the
purchase or repair of the equipment, photographic or video evidence of
abatement, or other
written records.

On or about Wednesday March 21, 2012 on site at 2156 Athens Highway
Gainesville, GA
30507;
a). The employees welding, cutting and making repairs on the excavators'
structure and
the grappling attachment were not certified. The excavator structure
repairs were made
by non certified employees who were not provided and did not follow the
Liebherr
structural repairs guidelines.
Among other methods, one feasible and acceptable means of abatement
include, but not limited,
to: The employer shall ensure they follow the manufacture recommendation
for
making repairs
on the structure of the equipment and using attachments.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in
addition, documentation demonstrating that abatement is complete must be
included with
your certification.  This documentation may include, but is not limited
to, evidence of the
purchase or repair of the equipment, photographic or video evidence of
abatement, or other
written records.
