Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard of up to 18 feet: a)At the air conditioning system located along the east wall of the production area of the facility: On July 20, 2011 and at times prior to; an employee was exposed to a fall hazard of up to 18 feet to the concrete floor below while working from inside a plastic parts bin that was placed on the elevated forks of a forklift. The employee was not provided conventional fall protection and the sides of the parts bin were not of sufficient height at 34 inches to function as guard rails to protect the exposed employee from fall hazards. Among other methods, one feasible and acceptable method to abate this hazard is to: Purchase and utilize a fall harness and lanyard as a method of providing fall protection for employees working from a platform elevated by the forks of a forklift.
