Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a) In the warehouse, racks at locations throughout the facility: On August 11, 2011 and at times prior to, the employer failed to maintain racks in that the racks were damaged at the base, exposing warehouse employees to struck-by hazards from falling product and rack sections while they work in the warehouse. Feasible and acceptable methods of abatement to correct this hazard include, but are not limited to the following: 1)Conform to procedures prescribed by the manufacturer in that all damaged components should be replaced. 2)Have the capacity of repaired storage racks certified by a registered engineer. 3)Conform to the American National Standard, MH 16.1: 2008, paragraph 1.4.1(2), that requires damaged racks to be replaced/repaired.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a) Warehouse: On or about August 11, 2011, the employer required employee(s) to operate high lift trucks to remove boxes from pallets on the storage racks by manually reaching out from the platform and getting the desired box or product without fall protection. The employee(s) work at heights of approximately 15 ft. Feasible and acceptable methods among others to correct the hazard is to: 1)Use a fall protection or restraining means such as rails, chains or a harness/body belt with lanyards or deceleration device as required by ANSI/ASME B56.1-2000 section 4.17.2.
