Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to struck-by hazards:
a)At Jerry Higgins Automotive:  On or about August 29, 2011 and at times
prior
the employer failed to protect employees from struck-by hazards due to
physical
deficiencies with the three vehicle lifts. The Bay 3 lift did not have
locks
available on the swing arm restraints, the Bay 2 lift did not have swing
arm
restraints, and the Bay 1 lift did not have swing arm restraints installed
on the
front side and the swing arm restraints on the rear side did not function
correctly
to allow the arms to lock in place.
b)At Jerry Higgins Automotive:  On or about August 29, 2011 and at times
prior
the employer failed to protect employees from struck-by hazards by not
instructing employees on the safe use and operation of the vehicle lifts,
using the
manufacturer provided instruction and warning labels.
c)At Jerry Higgins Automotive:  On or about August 29, 2011 and at times
prior
the employer failed to develop and implement a periodic inspection
schedule that
would have pointed out deficiencies such as but limited to Bay 2 and Bay 3
lifts
not having maximum lifting capabilities marked on the lifts, hydraulic
leaks at the
base of the Bay 3 lift, and the Bay 2 lift having a locking mechanism that
was not
functioning properly causing employees to use the handle of a floor jack to
support the lift as a secondary safety guard.
Among other methods, one feasible and acceptable method to correct this
hazard is to repair or
install swing arm restraints as required, placard the equipment with the
maximum lifting
capability, repair all hydraulic leaks, and repair all locking mechanisms.
For additional
guidance:
Item A: Follow the safety requirements in American National Standard
Institute / Automotive
Lift Institute ANSI/ALI ALOIM:2008 and follow the instructions in section
5.6.2.13 which
states, "On lifts requiring swing arm restraints, the swing arm restraints
shall be inspected".
Item B: Follow the training requirements in American National Standard
Institute / Automotive
Lift Institute ANSI/ALI ALOIM:2008 following the instructions in section
4.2.1 which states,
"The owner or employer shall ensure that operators of automotive lifts are
instructed in the safe
use and operation of the lift using the manufacturer provided instructions
and warning labels and
the Automotive Lift Institute publication".
Item C:  Follow the Periodic Inspection Procedure requirements in American
National Standard
Institute / Automotive Lift Institute ANSI/ALI ALOIM:2008 following the
instructions in section
5.1 which states, " The owner or employer shall establish a periodic
inspection procedure in
accordance with the recommendations of the lift manufacturer in order to
ensure reliability and
allow the continued safe operation of the lift".ion
