Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to commerical kitchen appliances with defective/broken components and mechanisms: A.)VFW Post #6166, 5550 East State Street, Hermitage, PA 16148, kitchen area, on or about October 5, 2011 and times prior thereto: The oven door chain mechanism on the Imperial ICV-2 Turbo-Flow Convection Oven is broken. Due to the broken chain mechanism, the doors of the oven will not stay fully closed or open in their respective positions. When the doors are in the open position, door can recoil back and strike pan, resulting to spilling / splashing of hot greases and liquids. When the door is in the closed position, cardboard is utilized to hold the door closed resulting in potential fire and burn hazards. Amongst other means, acceptable and feasible methods to correct the condition include: A.)Repairing and/or reinstalling the chain mechanism that will properly hold the door open and closed.
