Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to ejection from a forklift truck due to failure to utilize provided safety equipment A.Penn-Sylvan International, Inc., 21792 PA Route 8, Centerville, PA 16404, south end of the sawmill structure, on or about October 24, 2011 and times prior thereto: A forklift operator driving and utilizing a Hyster 210 forklift truck was not wearing the provided seat belt. ABATEMENT NOTE: Among other means, acceptable and feasible methods to correct the conditions include, but are not limited to: A)Develop a forklift truck safety program. B)Develop and implement a forklift truck training program. C)Train the employees on the importance of wearing seatbelts as required by ANSI/ITSDF B56.1-2009.
